"The holder of this certificate is entitled to
claim protection whilst carrying on business according to
Treaty in a Treaty Port and to receive the good offices of His Majesty's Consuls in case of injury to person or proper- -ty elsewhere".
21. It is probable also that the instructions of 1904
issued to Consuls require to be amended or clarified in
some way.

His Majesty's Consuls in China should also be
requested to inform the Government of Hongkong of all cases where Hongkong born Chinese in Class 3 register themselves
as British subjects, and should communicate with Hongkong
in every case that certificates have been misused, or that
holders of them have acted contrary to Treaty. This Govern-
-ment would then be in a better position to judge of the
results of the issue of the certificates.

Sir Henry Blake's two despatches on the subject are written from the proper standpoint, and nothing should be done by this Government to put it in the power of Consuls to refuse protection to gentlemen like Ho Kai, Wei Yuk, Fung Wa Chun, Lau Chu Pak, all of whom fall within class 3, whilst visiting Treaty Ports, on their good offices, if they should travel in the interior; but the present indiscrimi- --nate issue of certificates is certainly liable to be greatly abused. Protection should still be claimed for deserving persons in class 3, persons who satisfy the description given by Sir Henry Blake, but at the same time proper safeguards should be taken to prevent the certifi- -cates being misused, and on the other hand, to make clear to holders, the nature of the protection they will be given

Some confusion has arisen as to the duty of the Government to issue a certificate. There appears to be no such duty thrown on the Government as regards any class, least of all as regards Class 3 whose legal status is so obscure. There is no refusal to recognise a person's statuř
